Is Mortgage Debt That Is Discharged Taxable As Ordinary Income

Unfortunately, there seems to be more misinformation and urban myth floating around than good professional advice. If you have any reservations at all about your status, don't make any assumptions about this subject without consulting a lawyer or accountant.

The short answer is that Congress did pass the Mortgage Forgiveness Debt Relief Act of 2007, which does provide a lot of relief, and will probably benefit most of the folks that are most in need of the relief it provides. But if you have investment property or a HELOC, keep reading.

First of all, the general rule is that forgiven debt gives rise to "ordinary income" which is a taxable event ordinarily reported on IRS Form 1099. Historically, there has been an exception that if the taxpayer is insolvent (which means only that their debts exceed their assets) then the forgiven debt is not taxable to the extent of the insolvency. This means simply that if I owe $100 but my assets are only $80, then I am "insolvent" to the measurable tune of $20, and the amount of the forgiven debt that is not taxable would be limited to that $20. The filing of a bankruptcy petition gives rise to a "presumption of insolvency" which usually is the end of the issue and the taxpayer won't be taxed on the forgiven debt. Absent a bankruptcy petition, you would normally have to prove the insolvency to the IRS in order to avoid the tax.

Last year Congress passed H.R. 3648, the Mortgage Forgiveness Debt Relief Act of 2007. This statute, which is a change to the Federal tax code, creates a specific carve out to the general rule without requiring the taxpayer to prove insolvency or go through the bothersome chore of filing bankruptcy. But it is not the free ride that some news sources and pundit-sorts have made it out to be.

First, the real property securing the forgiven debt must be the taxpayer's principal residence, which means that the taxpayer had to have resided in it as a principal residence for the prior two years. A taxpayer can only have one principal residence. Second homes, vacation homes, investment property and raw land do not qualify. While this won't disqualify the mass of folks currently awash in the foreclosure paper chase from sea to shining sea, it means that this is not a safe harbor for investors.

Second, the amount is limited to $2 million. Not a huge obstacle in most parts of the country, but with real estate prices in the Bay Area being what they are, this limit could still hit some poor soon-to-be-homeless gazillionaire where it hurts.

Third, the window is only open for three years. The debt must be discharged between January 1, 2007 and January 1, 2010, unless extended before then. So if you're going to lose your home, you better hurry!

Fourth, the debt canceled must be a loan that was used to "acquire, construct or substantially improve" the property. Sounds innocent enough, but this will exclude many home equity loans and probably all home equity lines of credit. Given that a lot of the loans that are causing the most pain right now are second deeds of trust that might not have been purchase money loans, this limitation could catch a lot of folks looking in the wrong direction. If the loan that is about to adjust up and double the monthly payment on that second you took out to pay down some college tuition or credit card debt, this law won't help you.

Myth #1: Web Design is For Techies
This couldn't be further from the truth. There is free software out there like CoffeeCup that will aid you with your design. The templates have already been pre-created, so all you do is choose the one you want and insert your text.

Myth #2: Flash Will Enhance Any Website
If you plan on using any enhanced features such as Flash, be sure to use it efficiently and sparingly.

Myth #3: Lots of Colors Enhance A Web Site
Remember that actual humans will be reading your site so you want to make it as visually pleasing as possible. If your visitor's eyes hurt from reading your pages, they won't return.
Your site should consist of 2 to 3 colors max and remember that it's easier to read dark text on a light background. Even though red and purple may be your favorite colors, they don't generally team up very well for a text/background combination.
Also remember to make sure your hyperlinks are the same color on every page. Many believe you should only use the standard blue color for your links, but I disagree. As long as they contrast from the background and are consistent throughout your site, the color shouldn't matter.
Myth #4: You Can Never Have Too Many Images
When used sparingly, images can really enhance various pages on your web site. They are great for illustrating certain points, and if you're creating a personal site, you may want to add a photo album.
One very important thing to keep in mind about images is that they can make your pages load very slowly. If your page doesn't load within 10 seconds, you are in danger of losing many visitors.
Ideally, your pages should not be larger than 30K in size -- this includes the images and HTML. If you find that they are too large, use an image editing program to size your pictures down.
Additionally, ensure that all of your images are saved in the correct format. Photos should be saved in .jpg format (more colors), while web images, clip art, etc. should be saved in .gif format (fewer colors).
Also remember to always include the "height" and "width" HTML attribute on all of your images so your text will load first instead of waiting until all the images load.
Myth #5: Your Site Is Always Viewed Equally
This is a common mistake made by many webmasters. Just because your site looks fine on your PC, don't assume it looks that good everywhere.
Remember that different browsers handle HTML a little differently. So if you've checked your site in IE, make sure you also view it Netscape.
Also remember that not everyone has their resolution set to the same value. If you're building your site with your screen resolution set to 1024 x 768, make sure you view it in 800 x 600 as well. The latter is still the most popular, so you want to make sure your site looks fine there as well.
If you are using tables, you should set the widths in percentages rather than pixel values. That way if you have the width set to 80%, for example, it will take up 80% of the screen no matter what resolution you view it in.
On the other hand, if you set it to 900 pixels wide on your 1024 x 768 screen, it may look fine, but if someone else is viewing your site using 800 x 600, they will have to scroll left and right to view your entire page. That is a huge annoyance.

I have been receiving monthly checks from Google since 2003, and I've read numerous success stories of websites earning 5 digit incomes per month with AdSense.
Now, I will admit, a 5-digit commission in a single month is probably not the norm for most participants.
I promote AdSense on three of my websites and my checks have been as high as $4,500.
The more information you have, the greater chance you have of attracting free search engine traffic. That's why it's so very important you choose a topic you have an interest in so you can keep building and building.
My checks weren't always that large. I think my first month's earnings in 2003 totaled less than $20. However, I kept getting more and more search engine traffic by adding more content and the checks slowly began to increase. I had no idea it would grow to anything like this.
COPYCATS BEWARE!
I read an article about a lazy person that copied someone else's content word for word and pasted on their own site. They tried to join AdSense and they were rejected for unauthentic content. I don't know how Google found out their site was a duplicate of someone else's but they did.
Not to mention, the search engines are now ignoring pages with duplicate content. So all the thieves out there that are too lazy to come up with their own content are now finding that they cannot get their site ranked in Google, Yahoo and MSN simply because they've copied someone else's work.
It's not worth the risk. Not to mention, it's illegal to republish someone else's work without permission. That's why you should choose a topic you know a lot about or at least have a great interest in.
There's no reason to copy off someone else's site. Be original. Laziness always comes to bite you in the long-run.

So it is logical to believe that keyword phrases like debt free, employment, make money, mp3, sex, etc. will earn you more per click since these are highly competitive keywords that are searched for quite a bit on the web.
Advertisers generally pay more for popular terms because they are searched for more.
Even though Google will not reveal how much you are earning for each ad that is clicked from your site, you can still login to your account at any time and see the total amount of revenue you've generated that day, week, month, year, etc.
For example, if you see that you've made $12.60 today from 9 clicks then you can calculate that your average click-thru commission was $1.40 per click. That's as detailed as their stats will get. Also remember, that's only an average. You won't know how much each specific ad brought in.
The amount you'll earn also depends largely on the amount of targeted traffic you receive to your own site, how well the ads match your audience's interests, the placement of the ads on your pages, and of course the amount you receive per click.
Ideally, you should create a site on a topic you know a lot about. That way you'll have a much easier time creating a generous amount of content on that subject.
